No Win No Fee

The family of Milly Dowler - have spoken out in favour of No Win No Fee agreements.

Because without such an arrangment - the truth is that the Dowler family would have been unable to hold News of the World to account for its behaviour in hacking into their missing daughter's phone.

The family are quoted as saying that without the conditional fee agreement (CFA) - provided by their No Win No Fee arrangement:

"We would not have been able to start a case or even threaten it".

Although the background and type of case is very different - the same essential point is true in relation to equal pay.

If No Win No Fee agreements were not available - as some would like - then thousands of low paid council workers would have been left high and dry.

Because back in 2005 - before Action 4 Equality Scotland came on the scene - the only way low paid council workers could have taken up an equal pay claim - was via a trade union. 

But the Labour supporting trade unions - were unwilling to challenge the big Labour controlled councils - so in practice this was a right that existed in theory only. 

Because the unions were completely compromised - unwilling to take up the cudgels on behalf of their lowest-paid members.

Leaving aside the fact that lots of low-paid council workers - don't even belong to a trade union in the first place.

In practice access to justice for many thousands of low paid council workers - has been provided by the kind of No Win No Fee agreement - offered by Action 4 Equality Scotland.

The reality is that if things had been left to the trade unions - the council employers would still have been laughing - all the way to the bank.

No Win No Fee has changed the game in relation to equal pay - whether the unions like it or not.
