Feedback from the HBPC team confirms there are lots of 'big ticket' claims from employees involved in commission and sales.

Because it seems to be common practice amongst employers to be excluded commission payments during periods of annual leave.

So someone working as salesperson or an estate agent, for example, doesn't get credited with a significant part of their overall annual earnings and their pay may drop substantially whenever they take take a holiday. 

Which is what the holiday pay campaign is all about because people ought to be paid their 'normal' pay while on annual leave and the way to calculate this fairly, for example, would be to take an employee's average earnings over the 13 weeks prior to going on leave - and pay this 'average' figure during the 1, 2 or 3 week holiday period.  

In which case a person's average earnings would include everything from shift working to overtime and weekend working, but would also catch other payments such as fees and commission. 

So if you know someone who does a job that relies on fees and commission, encourage then to try this simple HBPC test which will establish whether or not they have a claim.

Here's a simple test to help discover if you have a holiday backpay claim.
  1. Take your entire wages for 3 months without holiday pay and divide by 3 to give you your average pay for those 3 months.
  2. Then compare this average pay with your pay in the month you were on paid leave. 
  3. If your holiday pay is less than your average pay, then it is less then it is highly likely you have a claim. 
If in doubt make a claim. 
If you don’t make a claim you won’t get paid anything - as many people found out to their cost over equal pay. 
If you the sums don't work out for you, then pass the word on to your friends, family members and colleagues as they may have a claim, especially if they work shifts or regular overtime.
