Head in the Sand

Having now read the full written decision of the Court of Session - in the case of Wilkinson v Edinburgh City Council - I am pleased to report that the highest court in the land - has given Edinburgh short shrift.

As regular readers will know three Scottish law lords heard the case back in June 2011 - Lord Eassie, Lady Paton and Lord Hardie - but their unanimous judgement contains not a crumb of comfort for Edinburgh City Council.

Instead of accepting the original Employment Tribunal decision - which accused Edinburgh of trying to 'defend the indefensible' - the City Council has been flogging the same dead horse for years.

The Court of Session reviewd the conclusions of initial Employment Tribunal back in 2008 - and concluded that the original employment judge had got it right - first time round.

So the last three years have been a complete farce - and all at taxpayers expense of course.

The original Employment Tribunal threw out the City Council's defence - because in plain, non-legal language it was 'laughable' - and also rejected the evidence of the council's key witness.

Yet three years on the City Council - the same City Council that brought us the fiasco of the Edinburgh trams - has had its head stuck in the sand.

In theory Edinburgh can appeal the unanimous Court of Session decision - to the UK Supreme Court.

But if they do it will be an even bigger scandal - and a complete waste of public money into the bargain.
