Edinburgh Update

Here's another update from Fox Cross Solicitors on the ongoing claims by former APT&C employees - against Edinburgh City Council.

The case has significance for other case and other councils - across the rest of Scotland.

Part of the problem is that councils have access to virtually unlimited public funds - and some have not been shy about using huge sums of public money to defend the indefensible.

Trying to defend the indefensible is how Edinburgh's behaviour was described - at the original employment tribunal hearing.

City of Edinburgh Council – Wilkinson and others v CEC

Following our important victory in the case of EAT against City of Edinburgh Council Lady Smith ruled that in equal pay cases, former white collar/APT&C employees can compare themselves with male comparators in manual worker posts.

This meant that thousands of Equal Value claims could proceed further in the tribunal system.

However the Council appealed the decision and this further appeal will be heard at the Inner House of the Court of Session.

We do not yet have dates but we will advise clients of further procedure as soon as we are advised of when this case will be heard.

Unfortunately this appeal may delay settlement of other Equal Value cases until we know the outcome of this appeal. We will keep you advised.
