Glasgow and Equal Pay



A number of readers have been in touch to say that the local Unison GCC branch has formed an Equal Pay Campaign Group which is beginning to hold regular meetings.

Now that's about 10 years late if you ask me, and the old phrase about closing the stable door after the horse has bolted springs to mind. 

But on the positive side, presumably the local Unison leadership is very different to the people who were running the show back in 2005/07, so maybe it's a case of better late than never.

In any event, I'm happy to work with the local Unison branch in the interests of achieving the best possible outcome for the council workforce - not least because A4ES and Unison are already working together to resist GCC's challenge to the Court of Session decision which recently judged Glasgow's WPBR pay scheme to be 'unfit for purpose'.

The same can't be said of the 'chancers' running the GMB, however, who were never part of the challenge to City Council's WPBR pay arrangements since the GMB union restricted its members equal pay claims in Glasgow to only three years - without asking the members what they thought of this bizarre behaviour.

Here's an email from a former member of the GMB who is suitably unimpressed at the union's belated efforts to jump on the equal pay bandwagon in Glasgow, after years of being what I would describe as a 'non combatant'.

I wanted to draw your attention to a letter the GMB have been sending out to their members claiming credit for your hard work.

I have also contacted them regarding this as their own Martin Doran (a GMB full-time official) refused point blank to support the janitors and told a room full of us that we would need a certain part of female anatomy to make a claim.

As regular readers know, the GMB did not support A4ES or the other trade unions in challenging Glasgow's WPBR pay arrangements which resulted in a recent landmark victory at the Court of Session in Edinburgh.

Yet the GMB's letter laughingly says the union "will be fighting tooth and nail to get all workers across GCC and associated employers equal pay justice."

The truth is that the GMB has made a mess of its members equal pay claims in Glasgow by restricting their claims to the 'pay protection period' only, as the union did in neighbouring North Lanarkshire Council more than two years ago.

So, far from getting justice the GMB has let its member down again, if you ask me, just as they did years ago when they told Glasgow Janitors (and other non-bonus earning male workers) that only women employees could pursue equal pay claims against their employer.   

As a matter of fact, Action 4 Equality Scotland established this right for non-bonus earning male workers, such as Janitors, which just goes to show that putting your equal pay claim in the right hands - makes a big difference to the outcome.

A kind reader from Glasgow has sent me a copy of the latest GMB Scotland leaflet on equal pay which deals with a number of issues including:

  • Pay Protection
  • Overtime and Male Comparators
  • Non Standard Working Pattern Payments 

Now I wonder if any readers in Glasgow can tell me what is so 'bat-shit crazy' about the GMB's comments on these three issues?

Glasgow and Equal Pay (06/07/17)


Here are some more of my thoughts on the letter from the GMB's Gary Smith which set the record straight over the fight for equal pay in Glasgow.
  • The legal process has been long and drawn out, as Gary says, but the real question for union members is: Why is the GMB the only claimant organisation that is not supporting the A4ES-led challenge to the council's job evaluation scheme and WPBR?
  • The very same thing happened in North Lanarkshire Council back in 2015, so you would have thought the GMB had plenty of time to get its act together before now. 
  • Action 4 Equality Scotland represents over 80% of the equal pay claimants in Glasgow because the trade unions lost all credibility with their own members, after siding with senior council management for years .
  • Action 4 Equality Scotland charges a fee (10% + VAT - 12% in total) because it provides a professional service and has a track record second to none over the years - were it not for A4ES union members would still be in the dark about the big pay differences between male and female jobs.
  • Trade unions charge fees as well - members in Glasgow have paid millions of pounds in  union contributions over the years, but if you ask me the members have received a very poor service in return.
  • All of the solicitors involved in the legal side of the fight for equal pay are 'private' solicitors - Digby Brown (whom the GMB sacked) and Thompsons both charge for their services and are paid out the monies raised from members' union fees or contributions. 
  • Abusive behaviour is always unacceptable, but if you ask me a 'few abusive phone calls' pales into insignificance compared to members being kept in the dark about theatre of their equal pay claims - in North Lanarkshire GMB members were having the wool pulled over their eyes until I stepped in and explained what was going on.
And, just for the record, I never charged the GMB members in North Lanarkshire a single penny for all the time and effort I spent in helping them get what they deserved after their own trade union had let them down.

I'll re-publish some of the comments I received from GMB members in North Lanarkshire and Gary Smith reasons himself to be thankful - because the debacle in North Lanarkshire ended up with his predecessor (Harry Donaldson) being removed from office and Gary Smith being his job as the GMB Scotland Secretary!

Dear GMB Member,

The legal action around Pay Protection / Equal Pay has been long and drawn out. The whole situation with Equal Pay is complex and it is further complicated by the appeal over the Glasgow City Council job evaluation process. As a union we have tried to communicate as best we can on the union's position on the cases.

As you know private solicitors are also involved in the cases against Glasgow City Council. These solicitors are driven by profit. They make money from the claimants they represent. The private solicitors will take money from any settlement. That is not the case with members of GMB Scotland. Every penny GMB Scotland secures for you through our solicitors Thompsons will go to you as an individual. We believe Thompsons are the preeminent Equal Pay lawyers in Scotland that's why we have appointed them to represent your interests.

We understand that some of the private solicitors appear to be making comments about the GMB and the trade unions in general which are causing confusion and concern to our members. GMB Scotland will not be responding to all the comments made by the private solicitors. When we have something we can communicate to our members we will and it will be done in a totally transparent way.

I understand that our staff at GMB Scotland have received a few abusive phone calls. I know this whole issue is frustrating for members but I will not tolerate our staff being abused; they are just workers like everyone else. If anyone feels that their interests would be better served by the private lawyers then they are free transfer their case to them.

Those who are members of GMB Scotland can be assured our lawyers will do all they can to get your equal pay claim resolved as soon as possible. If we need to take action over job evaluation, after the appeal judgement is known, we will. GMB Scotland will also communicate with you in an absolutely open and transparent fashion as and when there is something of substance to say. Above all as a member of GMB Scotland you can be assured that any money due to you will be paid to you, it is not going to line the pockets of fat cat private lawyers.

It should never be forgotten that the responsibility for all the problems with equal pay ultimately lie with Glasgow City Council. It was Glasgow City Council who discriminated against you and spent a fortune of tax payers’ money in the courts trying to defend the indefensible. Thank you for your patience and ongoing support

Now there are so many things wrong with Gary's letter I hardly know where to begin, but let's make start by reminding readers that:
  • the local trade unions in Glasgow kept their low paid women members in the dark for years about the pay differences between male and female jobs
  • the local trade unions in Glasgow agreed with City Council management to 'cap' the Equal Pay Compensation Payments at a maximum of £9,000
  • the local trade unions in Glasgow agreed with City Council management to exclude any overtime working from the Equal Pay Compensation Payments
  • the local trade unions in Glasgow agreed with City Council management to exclude certain categories of employee, e.g. School Janitors, from the Equal Pay Compensation Payments
  • the local trade unions in Glasgow agreed with City Council management to impose an even lower settlement cap (than £9,000) on certain categories of employee, e.g. Classroom Assistants
  • the local trade unions in Glasgow agreed with City Council management to ditch the job evaluation scheme (JES) recommended by the national unions (and COSLA) in favour of an 'in-house' JE scheme and WPBR developed by an external consultant
  • the local trade unions in Glasgow never once threatened strike action to bring the pay of the City's Council's largely female workforce into line with the much higher pay of their bonus earning male comparators 
  • the local trade unions in Glasgow threatened strike action to gain special treatment for the many 'red circled' and former bonus earning jobs (after the WPBR was introduced) - and were given a guarantee in the shape of the Employee Development Commitment (EDC) that   the earnings of these male dominated jobs would be maintained at their pre-WPBR levels
In other words if, as Gary Smith claims, Glasgow City Council was ultimately responsible for this widespread pay discrimination and "spent a fortune of tax payers' money trying to defend the indefensible" - why did the trade unions support senior managers instead standing up for the interests of their lowest paid members?
